What is Womply Storefront?
Womply Storefront webpages (each a “Storefront”) are sites where consumers can find useful information about local businesses and local businesses can engage their customers and keep them up to date. Except for information provided by its business owner or consumers, the information available on each Storefront comes from publically-available sources.
How do I claim my business on Womply Storefront?
To claim your Storefront, please create a Womply Account for your business. Only business owners or their authorized representatives may claim and manage information on a Storefront.
What if I want to update information on a Storefront?
If the Storefront for your business shows incorrect information or your business is permanently or temporarily closed, you can request to have its Storefront updated by first creating a Womply Account for your business. You must claim your Storefront before you can make any changes or updates.
The following content is not permitted on Storefront:
- Inaccurate or false information about your business or the services and products offered.
- Low-quality, irrelevant, or distracting content.
- Harassing, bullying, or hateful content.
- Content that promotes hatred or incite violence against individuals or groups based on ethnic origin, religion, disability, gender, age, veteran status, sexual orientation, or gender identity.
- Content related to terrorism, such as content that promotes terrorist acts, incites violence, or celebrates terrorist attacks.
- Profanity, sexually graphic and offensive slang terms, terms that are common signals for pedophilia, content that promotes pedophilia, bestiality, or sexual violence, or content that promotes escort services or other services that may be interpreted as providing sexual acts in exchange for compensation.
- Content related to the sale of dangerous and illegal products or services.
- Content that exploits or abuses children.
What other terms apply if I claim a Storefront?
If you claim a Storefront, then the following terms apply in addition to the Womply Terms of Service. Womply reserves the rights to update these terms from time to time. By claiming a Storefront, you have accepted these terms and your continued use of a Storefront means you are consenting to any updates. If you do not wish to agree to these terms, please do not claim a Storefront.
You must be 18 years or older to claim a Storefront. In addition, you confirm that you are the owner of the business listed on the Storefront or an authorized agent who is able to bind others on behalf of the entity.
You must bind any users that manage or subsequently own your business to these Storefront terms before making them managers or owners.
You are responsible for your business. Specifically, you must comply with all applicable laws and industry best practices when operating and promoting your business, including obtaining all applicable licenses and approvals; ensure your content is lawful, correct, up-to-date and complete; and supply all required disclaimers, warnings, and notices.
If Womply determines in its discretion that you have violated these terms, we reserve the right to de-verify you as the business owner of a Storefront.
While Womply is not responsible for the business listed on a Storefront, once you claim a Storefront, you understand that we have the right, but not the obligation, to moderate the content you supply via your Storefront. Furthermore, we may not choose to display your content, may choose to show only an edited version of your content, or may choose to show content from an alternate source in place of your content.
You also give Womply a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to reproduce, adapt, modify, translate, publish, publicly perform, publicly display, distribute, and create derivative works of the basic listing information about your entity that you provide to your page (such as the entity name, location, phone number, category, hours, and website). You confirm and warrant to Womply that you own or have all of the necessary rights or permissions to grant this license. You also grant to end users of Womply the right to access and use, including the right to edit, that information as permitted under the applicable Womply terms of service. All other content that you provide to your page (such as business photos) is licensed to Womply under its Terms of Service.
You must accurately represent your business as it exists in the real world, and you must ensure your business address and other contact information is accurate.
Your name should reflect your business’ real-world name, as used consistently on your storefront, website, stationery, and as known to customers. Accurately representing your business name helps customers find your business online.
Womply does not tolerate fraudulent or illegal activities.
Any promotion, marketing, contests, or other giveaways should clearly link to the terms of the activity and provide clear guidelines and qualifications. All such promises, given or implied, should be adhered to.
The federal Communications Decency Act (47 U.S. Code § 230) limits the liability of interactive computer services, like Storefront, for their role in publishing third-party content, including consumer reviews. Additionally, anti-SLAPP laws, such as Cal. Civ. Proc. Code § 425.16 in California, may require you to pay Womply’s attorneys’ fees if you attempt to impose such liability on Womply through legal proceedings.
What if there is a dispute about my use of Storefront?
EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED IN THE ARBITRATION AGREEMENT SECTION IN WOMPLY’S TERMS OF SERVICE. YOU AGREE THAT DISPUTES BETWEEN YOU AND US WILL BE RESOLVED IN ACCORDANCE WITH WOMPLY’S TERMS OF SERVICE BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
